Thank you for choosing to work with Sleepy Goodness. I’m excited to partner with your family on your journey toward better, more restful sleep.
Please read this agreement carefully, as it outlines the terms of our collaboration and helps ensure a clear, positive experience for both of us. These Terms and Conditions apply to all services provided by me, Nadine Lim (trading as Sleepy Goodness) to you, the client. By engaging my services, you agree to be bound by these terms. The specific services, duration, and fees applicable to your chosen package are outlined in your invoice, booking confirmation, or on the website at the time of booking.
1. Goal
My primary goal is to help your child achieve safe, quality sleep and to help you get more of that quality sleep too. Based on the information you share, additional goals may include helping your child fall asleep independently, reducing night feeds, or creating a happy bedtime routine for the family.
2. Client Responsibilities
To ensure success, you agree to:
• Provide accurate and complete information about your child’s health, feeding, and sleep habits.
• Follow safe sleep guidelines from Red Nose Australia and the AAP Safe Sleep Recommendations. You agree to notify your consultant of any unsafe sleep practices or concerns, and understand that your consultant is not liable for your baby’s safety - you remain fully responsible for implementing safe sleep practices at all times.
• Seek medical advice if you have any concerns about your child’s health or development.
• Disclose any medical conditions your child has to your sleep consultant. If your child has a medical condition, you confirm that you have sought approval from your healthcare provider before commencing a sleep plan.
• Acknowledge that it is your responsibility to rule out any possible medical causes of sleep difficulties (such as sleep apnoea), as a child with underlying medical issues may not be suitable to begin a sleep plan.
• Ensure that your child is otherwise healthy, thriving, and gaining weight appropriately before starting a sleep plan.
• Understand that all decisions regarding your child’s sleep or feeding arrangements remain your responsibility. Sleepy Goodness provides guidance and suggestions, and you are solely responsible for deciding whether and how to implement any recommended changes.
• For packages that include a Sleep Plan, complete the sleep questionnaire accurately, implement the plan consistently, and log sleep and wake-up times in the sleep app as instructed.
3. Scope of Services
I provide infant and child sleep consulting services through my business, Sleepy Goodness, including but not limited to:
• Sleep assessments and consultations
• Personalized Sleep Plans
• Follow-up support (via our connected sleep consulting app or email, as agreed)
• Educational resources, including free resources, paid guides, and other materials designed to support families in improving sleep
These services and materials are educational and supportive in nature and are not intended to replace medical advice or treatment.
4. What You Can Expect from Me
I will be here as your coach and cheerleader. You can contact me by sending me a message via our connected sleep consulting app or via email during the agreed support period. A fair use policy applies to messaging or emailing Sleepy Goodness with questions and concerns.
Messages and emails will typically be answered as soon as possible during business hours, usually within 1 business day. Business hours are Monday to Friday, 9:00 am - 5:00 pm NZT, and Sleepy Goodness is closed on Saturdays, Sundays, and New Zealand public holidays. Messages received outside of business hours will be responded to on the next business day.
• For packages that include follow-up support, the follow-up period commences immediately after the initial phone consultation.
• For consultation-only packages, the session will focus on answering your questions and concerns based on the information you share. No follow-up support is included unless specifically agreed in your invoice or booking confirmation.
• The specific inclusions, duration, and details of your chosen package are outlined in your invoice, booking confirmation, or on the website.
5. Payments
• The total cost for services will be clearly displayed at the time of booking. Payment may be made directly through the website’s booking/payment system or, if preferred, via invoice provided by Sleepy Goodness.
• Payment is due in full before the Sleep Questionnaire is sent and before any services begin. Consulting services, including sending the Sleep Questionnaire and developing the Sleep Plan, will only begin once payment has been received.
6. Cancellations and Refunds
• Cancellations made more than 72 hours before the scheduled consultation call are eligible for a refund minus a 20% administration fee.
• Cancellations made less than 72 hours before the scheduled consultation call are eligible for a 50% refund of the fee.
• Once the Sleep Plan has been delivered, or a consultation has taken place, no refund will be offered.
7. Rescheduling, Timely Communication, and Expiry
• Please provide at least 48 hours’ notice to reschedule any appointment. Late notice may incur additional charges.
• Timely communication is essential for effective support. If I do not receive a response to messages within a reasonable time frame, it may impact the level of support I can provide. Continuous non-responsiveness may result in the termination of services.
• In the event of unforeseen circumstances (e.g., illness, emergencies), both parties will communicate to reschedule sessions.
• Expiry Clause: For packages that include follow-up support, the support period ends at the conclusion of the agreed package duration. If any sessions need to be postponed due to unforeseen circumstances, they must be rescheduled and completed within three months from the payment date. Any unused sessions after this period will expire and cannot be refunded or transferred. For consultation-only packages without follow-up support, this clause does not apply.
8. Termination for Misconduct
Sleepy Goodness is committed to providing a safe, respectful, and supportive environment for all clients. We reserve the right to end any sleep support package early if the client engages in behaviour that is consistently disrespectful, abusive, or threatening.
In such cases:
Services may be discontinued immediately.
Refunds will not be provided for any unused sessions/service.
This measure ensures the safety and well-being of both the consultant and other clients.
9. Confidentiality and Data Protection
Sleepy Goodness is committed to protecting your privacy in accordance with New Zealand’s Privacy Act. Personal data, including your name, contact details, and child’s information, will be:
• Collected only for the purpose of providing services
• Stored securely and not shared without your explicit consent, except as required by law
Use of online forms and email:
• Personal data collected through the website, including via contact forms or free guides, will be stored securely using trusted third-party platforms (e.g., Systeme.io) and used only to provide services, respond to inquiries, or send newsletters and promotional emails.
• You may opt out of future marketing emails at any time.
You have the right to request access, correction, or deletion of your data, subject to legal requirements. Contact [email protected] for data-related inquiries.
10. Testimonials and Media Release
Your personal and family information, including sleep logs, family details, and other sensitive data, will be kept strictly confidential in accordance with applicable privacy laws. Anonymised materials from our work together may be used for promotional purposes, such as testimonials, case studies, or educational materials.
Sleepy Goodness typically uses only the parent’s first name when sharing testimonials, unless you have already made your testimonial public (for example, through a Google Review or social media post), in which case it may be shared as written.
If you prefer that your information not be used in this way, please inform me in writing. If you choose to provide a testimonial, you grant permission for its use in marketing and educational materials.
11. Intellectual Property
All materials, resources, and tools provided by Sleepy Goodness, including but not limited to the Sleep Plan, free resources, paid guides, and any other content, remain the intellectual property of Sleepy Goodness. You are not permitted to share, reproduce, or distribute these materials to third parties without prior written consent.
Your customised Sleep Plan is intended for your child only. Information may not be suitable for another child.
12. Results
Individual results may vary, and the outcome of the Sleep Plan, any free or paid resources, and guidance depends on many factors, including but not limited to the child’s age and developmental needs, the severity of existing sleep challenges, consistency in implementation, commitment to the plan, adherence to recommended techniques, effective communication with Sleepy Goodness, and the parents’ motivation and approach to change.
By engaging Sleepy Goodness services or using any resources, you accept that no refunds will be provided based on dissatisfaction with results.
13. Disclaimer
Sleepy Goodness provides sleep consulting services and educational resources, including but not limited to the Sleep Plan, free resources, and paid guides. These are based on expertise and experience, and are not medical advice.
You acknowledge that:
• You are responsible for deciding how to use the Sleep Plan, any free resources, paid guides, or other materials provided by Sleepy Goodness, and for consulting a paediatrician or healthcare provider for any health concerns.
• Sleepy Goodness is not liable for outcomes resulting from your implementation or misuse of any advice, resources, or materials.
• By proceeding with services or using any Sleepy Goodness resources, you release Sleepy Goodness from any legal claims arising from their use, to the fullest extent permitted by law.
14. Indemnification
You agree to indemnify and hold Sleepy Goodness harmless from any and all claims, losses, damages, and expenses (including legal fees) arising out of your use of the Sleep Plan, any free resources, paid guides, or other materials provided by Sleepy Goodness, as well as any services provided, to the extent permitted by law.
15. Governing Law
This agreement is governed by the laws of New Zealand. By engaging Sleepy Goodness services, you agree that any concerns or disputes will first be addressed through open and good-faith communication. If a resolution cannot be reached, the matter will be handled in accordance with New Zealand law. You agree that any legal proceedings must be initiated exclusively in a New Zealand court.
16. Client Acknowledgment
By making payment for Sleepy Goodness services, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
